You agree that any videos or pictures taken of you while on our tour or while visiting the Mae Wang Zipline Park can be used by Elephant Freedom Project or Mae Wang Zipline Adventure in any way we deem appropriate.

Elephant Freedom Project has no control over and assumes no responsibility for third-party websites or services’ content, privacy policies, or practices. You further acknowledge and agree that Elephant Freedom Project shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such web sites or services.

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

ZIPLINE RELEASE OF LIABILITY – PLEASE READ

For safety purposes, it is not recommended that women over 0 months pregnant, children aged 0-5, and anyone with a heart condition participate in this activity.

Rules and Regulations. I have read the safety policy below for the ‘Maewang Adventure’ activity. I have understood and agreed to take part in the adventure activity with full knowledge of the risks intrinsic to it, including, without limitation, personal injury or death.

I also understand that I am not permitted to carry out this activity if I have any of the following conditions or injuries:(2.1) Pregnancy(2.2) Any mental and health condition(2.3) Diabetes(2.4) Epilepsy(2.5) Any heart, lung, kidney or liver condition or previous operation or injury. (2.6) Any back, hip, leg, knee, feet, shoulder, hand, or neck injuries. I hereby confirm that:

• 1. I have no medical or other condition, injury, or injuries, including those above, which means I cannot participate in the skyline Adventure.
• 2. I am not under the influence of any drugs (for recreational, medical, or otherwise)
• 3. I am not under the influence of alcohol.
• 4. I am fit and can carry out the Maewang Adventure activity.
• 5. I weigh less than 120 Kilos.3.

I hereby release ‘Maewang Adventure and Elephant Freedom Project’ and waive all claims, liabilities, actions, losses, expenses, and costs (including without limitation all medical or hospital costs, repatriation costs, and any other personal injury) arising from or which are incurred as a result from my participation in the adventure activity except for any liability which may not be excluded under Thai law.

I acknowledge that ‘Maewang Adventure’ relies on the confirmation and undertaking set out in 3 paragraphs above to take me on the skyline adventure activity. I hereby indemnity ‘Maewang Adventure’ against any losses, liabilities, claims, costs, and expenses (including any claims made by any other person carrying out the adventure activity at the same time as me) incurred by ‘Maewang Adventure’ or arising from or as a result of or in connection with my confirmation or undertaking not being correct.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Thailand without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held invalid or unenforceable by a court, the remaining provisions of these Terms of Service will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 15 days’ notice before any new terms take effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you disagree with the new terms, please stop using the Service.
